Synopsis

Study Material for the Course The EU Judicial System: Collection of Exercises. This study material is intended for second cycle students at the Faculty of Law, University of Maribor, enrolled in the course The EU Judicial System. It gives an overview of proceedings before the Court of Justice of the European Union (CJEU) and categorizes direct actions as those against Member States and those against EU institutions, followed by practice exercises on the preliminary ruling procedure, which is the only representative of indirect proceedings. Two chapters at the beginning of the material are intended to refresh knowledge of the fundamentals of EU law, with a focus on the relationship between EU law and national law, as well as the role of the CJEU in the EU institutional architecture. The material assesses and tests student’s knowledge through theoretical questions, points for discussion and practical examples.

Author Biographies

Janja Hojnik, University of Maribor, Faculty of Law

Dr. Janja Hojnik is Doctor of Juridical Science, Bachelor of Laws, BSc (Econ), with State Juridical Exam, Full Law Professor of the University of Maribor, Faculty of Law and Jean Monnet Chair Professor of EU Law. Vice-Rector of University of Maribor for Quality, HR and Legal Affairs (2018-2022) and Head of the Master's Degree in European Legal Studies (from 2019). After graduating from the Faculty of Law (2002) and the Faculty of Economics and Business at the University of Maribor (2003), she worked for one year as a trainee judge at the High Court in Maribor, and since November 2003 she has been employed at the Faculty of Law at the University of Maribor (initially as a young researcher), where she obtained her PhD in EU law in 2007 and was habilitated to the rank of full professor in June 2018. She teaches and researches in the field of EU Law (internal market, price regulation, international trade, digital economy).

Petra Weingerl, University of Maribor, Faculty of Law

Dr. Petra Weingerl is an Assistant Professor at the Faculty of Law, University of Maribor. After she obtained diplomas in law and economy at University of Maribor, Petra completed her doctorate and Magister Juris (with Distinction) at the Faculty of Law, University of Oxford. Her doctoral thesis dealt with effective judicial protection and damages in EU law. It was supervised by Professor Stephen Weatherill (and Professor Stefan Vogenauer until he became the director of Max Planck Institute in Frankfurt). Her teaching and research activities at the Faculty of Law in Maribor focus on EU law, international law and comparative law. She also teaches EU Law and Policy course at the University of Trieste.

Živa Šuta, University of Maribor, Faculty of Law

Živa Šuta is an academic assistant at the Faculty of Law of the University of Maribor, where she is also pursuing her doctoral studies. Her research interests include digitalisation and green transition, fundamental rights and international law. She teaches EU law tutorials as part of her teaching activities. During her studies she participated as a competitor and coach in several moot court competitions. Throughout her studies, she was ranked among the top 5% of students in her generation and received numerous awards and recognitions (two Perlach Awards from the University of Maribor for achievements in research and competitions, two awards from the Municipality of Ptuj for the Best Student at Bachelor's and Master's studies, and the Award for the Best Student at the University of Maribor 2021/22).
