Synopsis

Poglavje obravnava pravno ureditev na področju odprtih podatkov, prostorskih informacij in neosebnih podatkov v pravu Evropske unije, kot jo vzpostavljajo Uredba 2018/1807, Direktiva 2019/1024 in Direktiva INSPIRE. Predstavljene so njihove ključne materialnopravne rešitve, cilji ter izbrana vprašanja razlage posameznih določb, pomembna za razumevanje obveznosti držav članic. Poseben poudarek je namenjen njihovim pravnim učinkom v slovenskem pravnem redu ter vprašanjem nacionalne implementacije, vključno z izbranimi ustavnopravnimi vidiki. Poglavje osvetli tudi razmerje obravnavanih aktov do drugih pravnih virov EU s področja podatkov, zlasti varstva osebnih podatkov in novega evropskega okvira upravljanja podatkov.

Author Biographies

Marjan Kos, University of Ljubljana, Faculty of Law

Dr. Marjan Kos is an Assistant Professor of administrative law and public administration at the Department of Administrative Law. In his teaching and research, he primarily focuses on public EU law with a focus on fundamental rights and administrative EU law, transparency, integrity and prevention of corruption as well as administrative procedure, administrative dispute and tax law.

Jaka Kukavica, University of Ljubljana, Faculty of Law

Dr. Jaka Kukavica, LL.M. (Cantab) is an assistant professor at the Department of Constitutional Law at the University of Ljubljana Faculty of Law. He obtained his LLM at University of Cambridge and European University Institute, where he also defended his doctoral thesis in 2024. For the dissertation titled "Structural Values in Judicial Reasoning: Consensus Analysis in Constitutional and Supranational Contexts," he received the Mauro Cappelletti Prize for the best thesis in comparative and European law. He has been a visiting researcher at Georgetown Law Center, University of Michigan Law School, iCourts Center of Excellence at the University of Copenhagen, Utrecht University, and Australian National University College of Law. He is a member of the editorial board of the European Journal of Legal Studies, where he acted as the Head of Section for European law between 2020 and 2023.

Matija Damjan, University of Ljubljana, Faculty of Law, Institute of Comparative Law

Dr. Matija Damjan is an associate professor of civil and commercial law at the Faculty of Law, University of Ljubljana, director of the Institute for Comparative Law at the Faculty of Law in Ljubljana, and editor of the Pravni letopis journal. He passed the state bar exam in 2005 after completing an internship at the Higher Court in Ljubljana. In 2007, he received a doctorate from the Faculty of Law, University of Ljubljana and has since been engaged in scientific research in law. His research and teaching focus primarily on intellectual property law, civil law, and information society law.

Lucija Strojan, University of Ljubljana, Faculty of Law, Institute of Comparative Law

Lucija Strojan is a teaching assistant in civil and commercial law at the Faculty of Law of the University of Ljubljana and a researcher at the Institute for Comparative Law at the same faculty. After completing her master’s degree at the Faculty of Law of the University of Ljubljana, she undertook a judicial traineeship at the Higher Court in Ljubljana and passed the Slovenian bar exam in 2025. She is currently enrolled in a doctoral programme in law at the Faculty of Law of the University of Ljubljana, where her doctoral research focuses on the interplay between civil and anti-discrimination law.

Katja Štemberger Brizani, University of Ljubljana, Faculty of Law, Institute of Comparative Law

Dr. Katja Štemberger Brizani is an Assistant Professor in the Department of Administrative Law at the Faculty of Law, University of Ljubljana, and a researcher at the Institute for Comparative Law. She has been employed at the Faculty since 2018; she passed the Slovenian bar examination in 2021 after completing a voluntary judicial traineeship at the Higher Court in Ljubljana, and obtained her PhD in 2023 in the field of administrative contracts. In her teaching and research, she focuses on administrative law and related legal disciplines. She is the Programme Chair of the Days of Concessions conference, the founder of the Legal Clinic on Public Procurement, Concessions and Public–Private Partnerships, and a co-mentor of the Faculty of Law team at the Data Protection Moot Court competition. Her research work includes contributions to national and international academic journals and chapters in monographs, and she regularly participates in professional and scientific conferences. She has also worked as a visiting researcher at the Masaryk University Faculty of Law in Brno.
