Misdemeanour Aspects of Public Safety at the Municipal and State Level

Misdemeanour law in Slovenia is at a turning point in its development. Exceptional security events sometimes have too rapid impact on the legal regulation of misdemeanours. We note that modern misdemeanour law can change ad hoc in such a case. In this article, we discuss the tragic death of Aleš Šutar in Novo mesto at the end of 2025. This unfortunate case quickly led to the adoption of the interventionist Act on Emergency Measures to Ensure Public Safety, which, in our opinion, represents a deviation from the current systematics of misdemeanour law. The unsystematic ad hoc introduction of new misdemeanours may interfere with the generally protected constitutional right of safety. We analyse the case from the above-mentioned perspective and draw attention to regulatory deviations. Future changes to misdemeanour regulations require an interdisciplinary concept that, in addition to legal analysis, will also include criminological and social welfare perspectives.
